Any person requiring residential care the local authority has a legal obligation to provide that care under regulation 35 of the Social Services Wellbeing Act 2014. Therefore the local authority must provide a choice of where the person wants to live. Choice of accommodation is enshrined in the Social Services and Wellbeing Act 2014.
If the local authority cannot provide that choice that they normally would expect to pay, which would be the level they set, then they must provide the choice in a facility that is more expensive and meet the cost themselves. The Social services and wellbeing act code of practice annexe C clearly mandates the above.

The funding threshold is currently £50,000. This capital limit determines whether a person pays their entire assessed care costs or whether they receive financial support towards the cost from their local authority
